We know what AI does not tell you
Old vs. New
EmpCo applies to commercial practices from the applicable date. A completed historical communication is different from packaging, webpages or campaigns that continue to be presented to consumers. The real question is whether the claim remains part of an active commercial practice.
Grey Areas
A claim may be technically accurate and still create a misleading overall impression. Context, prominence, wording, disclaimers, imagery, colours and the interaction between text and visuals can all matter. AI can flag risks; it cannot turn every case into a simple yes/no answer.
Evidence Matters
Having an LCA, carbon-footprint calculation or certificate somewhere in the organisation does not automatically substantiate a claim. The evidence must correspond to the specific claim, scope, product and assumptions used.
Audit Trail
